Mark Gastineau’s lawsuit has been thrown out by a federal judge. A year ago, Gastineau filed a case against ESPN, the NFL, NFL Films, and co-directors James Weiner and Ken Rodgers, alleging unauthorized use of his name and likeness.
He also claimed a breach of contract and other claims related to a scene from the ’30 for 30’ documentary. How did Brett Favre get involved in this? Let’s find out.
Gastineau, a New York Jets legend, retired from the game as a single-season sack record holder. He recorded 22 sacks in 1984, and he was the record holder until 2001, a decade after his retirement.
Even though he never won the Super Bowl, his individual accomplishments with the Jets earned him the Jets Ring of Honor induction. In January 2002, Gastineau’s record was broken by Michael Strahan, who recorded his 22.5th sack against the Green Bay Packers.
In that game, he sacked the Packers quarterback at the time, Brett Favre. So, what was the controversy, and what made Gastineau sue several parties?
In 2023, Gastineau confronted Favre and accused him of diving in order to help Strahan break his all-time record. A clip of the same was shared by ESPN in December 2024. That footage of the confrontation was recorded by ESPN at a memorabilia convention.
When the channel showed the footage as part of ’30 for 30’, a documentary on the New York Sack Exchange, Gastineau took the legal route. His lawsuit alleged that he did not consent to be recorded and claimed that the footage was edited in a way that made it look more hostile than it was.
Gastineau filed the lawsuit for $25 million, claiming a breach of contract regarding the use of his image in the documentary.
What Did the Judge Say in Mark Gastineau’s Case?
U.S. District Judge Paul A. Engelmayer dismissed the lawsuit with prejudice. As per the judge, Gastineau, “consented, in writing, to the use of his name and likeness in the film and related promotional materials.”
The judge stated that his exchange with Favre was newsworthy and “that authorization was broad and encompassed Gastineau’s name and likeness as reflected in extrinsic footage, such as that of the encounter with Favre.”
Judge Engelmayer noted, “It is newsworthy in that the participants were nationally recognized football stars (Favre is a member of the Pro Football Hall of Fame), the exchange between them concerned a venerated NFL record, the incident featured prominently in the film, and, as the film reflects, Gastineau’s aggressive conduct appears to have driven a wedge within the Sack Exchange quartet that was the subject of the film.”
None of the parties or their representative have commented on the dismissal.
