Aden Holloway’s absence from Alabama is one of the biggest stories in college basketball. Days before the start of March Madness, Holloway was arrested in relation to first-degree marijuana possession and failure to affix a tax stamp.
Alabama beat writer Nick Kelly obtained a document outlining the probable cause employed, which led to the arrest and the search of Holloway’s residence that led to the star’s arrest.
“Conducted a trash pull after receiving complaints,” the documents read. “Your affiant observed on the trash can by the curb, with (redacted) written on the lid. Agents pulled two household trash bags from the trash can.”
In one of the trash bags, there was a box with a shipping label on it (redacted address) addressed to ‘Ayden Holloway.’ In another trash bag there was more items with Holloway’s name on it.
In the same bag there was loose marijuana stuck to a cat foot container and a partially smoked marijuana blunt. Agents ran Ayden Holloway’s information, which his license returns to the same address.”
It is unclear whether Holloway’s name was spelled differently due to a clerical error or if Holloway used a different spelling of his name to help keep his identity in his private life separate. Other reasons could exist.
Why Police Were Legally Allowed to Search Aden Holloway’s Trash Bags
Of course, the ability for police to search trash bags has been a controversial one for decades, as some have argued that the bags deserve a right to privacy and protection from unlawful searches and seizures. However, as ruled in California v. Greenwood in 1988, per Oyez, the Supreme Court upheld the police’s ability to search trash placed on the street.
The probable cause document in connection with Aden Holloway appears to fit the criteria needed for a search to be conducted. As a result of the search, police believed they had obtained the evidence necessary to arrest the star.
However, the true spark for the situation appeared to be the “complaints” police received. The complaints appeared to be the reason for the police to arrive at the residence. The nature of the complaints did not appear to be included in the document.
As a result of the arrest, Holloway was suspended by Alabama, according to a Wednesday CBS Sports report.
